Terms of Service

These Terms of Service (“Terms”) govern your use of Coachocracy (“we,” “us,” or “the service”), operated by Arthunch LLC, a United States limited liability company. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the service.

1. What Coachocracy is

Coachocracy is a self development and exam preparation tool for coaches. It analyzes a coaching conversation you provide and returns practice feedback mapped to coaching competencies, including evidence, gaps, and suggested rewrites. The feedback is an indicative practice estimate meant to help you develop, not an official evaluation.

2. Not affiliated with ICF; no credential is granted

Coachocracy is an independent tool. It is not affiliated with, endorsed by, or sponsored by the International Coaching Federation (ICF). ICF, International Coaching Federation, ACC, PCC, and MCC are trademarks of the International Coaching Federation and are used here only to describe the credentialing process you may be preparing for.

The service does not grant, confer, or guarantee any ICF credential and is not a substitute for an official ICF performance evaluation or exam. Our feedback does not represent ICF and does not predict an official result.

3. No guarantee of results

We do not guarantee that using the service will result in passing any exam, obtaining any credential, or achieving any particular score or outcome. Assessment feedback is generated by automated analysis, may contain errors, and should be used as one input into your own development rather than as a definitive judgment.

4. Eligibility and your account

• You must be at least 18 years old to use the service.
• You agree to provide accurate account information and to keep your login credentials secure.
• You are responsible for activity that happens under your account.

5. Your content and your responsibilities

You keep ownership of the transcripts, recordings, and other content you provide (“Your Content”). You grant us a limited license to store and process Your Content solely to provide the service to you, including sending it to the service providers described in our Privacy Policy.

You represent and agree that:

• You have obtained informed consent from every person recorded in Your Content to record the session and to process it with a third party tool that uses AI.
• You have the right to upload and share Your Content, and doing so does not violate any law or any other person’s rights.
• You will not upload content that is unlawful, or that you are not authorized to share.

6. Acceptable use

You agree not to:

• Use the service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the service, other accounts, or our systems, or otherwise interfere with the security of the service.
• Copy, resell, or commercially exploit the service or its output except for your own coaching development.
• Misrepresent the service’s feedback as an official ICF result or as evidence of any credential.

7. Intellectual property

The service, including its software, design, and the original analysis and feedback it produces, is owned by us and protected by law. The coaching competency frameworks referenced by the service are the property of their respective owners, including ICF. Our own guidance and analysis are our content; the authoritative competency and marker text remains the property of ICF.

8. Third party services

The service relies on third party providers, including those named in our Privacy Policy. Your use of the service is also subject to those providers’ terms, and we are not responsible for their acts or omissions.

9. Fees

The service is currently offered without charge. We may introduce paid plans or usage limits in the future. If we do, we will make the terms clear before you incur any charge.

10. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the service will be uninterrupted, error free, or that its feedback will be accurate or complete.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of Your Content, your use of the service, or your violation of these Terms or of any third party rights, including the rights of anyone recorded in Your Content.

13. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we need to protect the service or other users. Provisions that by their nature should survive termination will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page. Your continued use of the service after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the United States and of the state in which Arthunch LLC is organized, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the state and federal courts located in that state, unless applicable law requires otherwise.
